Scope of application
For all deliveries of SIEVE Plastic UG (haftungsbeschränkt) (hereinafter referred to as Sieve) to consumers and entrepreneurs, these General Terms and Conditions (GTC) apply. Other terms and conditions do not apply, we expressly object to them.
A consumer is any natural person who enters into a legal transaction for a purpose that is predominantly neither commercial nor self-employed. An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.

The purchase contract is concluded with SIEVE Plastic UG (haftungsbeschränkt), Managing Director: Sebastian Tettenborn, Kerkenbrock 26, 33824 Werther, Commercial Register: Gütersloh Local Court, HRB 12336.

Conclusion of contract

The presentation of the products in the online store does not constitute a legally binding offer, but only an invitation to order.

By clicking the button [Buy/order with costs] you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation by e-mail after receiving your order.
Prices and shipping costs
The prices stated on the product pages include the statutory value added tax. For deliveries to countries outside the European Union, additional costs may be incurred in individual cases, for which the seller is not responsible and which are to be borne by the customer. These include, for example, costs for the transfer of money by credit institutions (e.g. transfer fees, exchange rate fees) or import duties or taxes (e.g. customs duties). Such costs may also be incurred in relation to the transfer of funds if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.
In addition to the prices indicated, we charge for delivery the shipping costs indicated in the ordering process in euros per order. The shipping costs will be clearly communicated to you again on the product pages, in the shopping cart system and on the order page.

Delivery

The delivery takes place within Germany with DHL.

Defects that were already known to the buyer at the time of purchase

If, in spite of all due care, the delivered goods show a defect which was already present at the time of the transfer of risk, we shall, at our discretion, either repair the goods or supply replacement goods, subject to timely notification of defects. We shall always be given the opportunity to remedy the defect within a reasonable period of time. Claims under a right of recourse shall remain unaffected by the above provision without restriction.
Payment

Unless otherwise stated in the Seller's product description, the prices quoted are total prices which include the statutory value added tax. Any additional delivery and shipping costs will be indicated separately in the respective product description.

The payment option(s) will be communicated to the customer in the online store of the seller.

The payment is made optionally via the payment service providers indicated in the online store.

The goods will be delivered after receipt of payment.
Retention of ownership

The goods remain our property until payment has been made in full.

The customer shall only have the right to offset if his counterclaims have been legally established or are undisputed. The customer shall only be entitled to exercise a right of retention insofar as his counterclaim is based on the same contractual relationship.

Applicable law, place of jurisdiction

This contract is subject to the law of the Federal Republic of Germany (excluding the UN Convention on Contracts for the International Sale of Goods).

If the customer acts as a merchant, a legal entity under public law or a special fund under public law with its registered office in the territory of the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract shall be the place of business of the seller. If the customer has its registered office outside the territory of the Federal Republic of Germany, the seller's registered office shall be the exclusive place of jurisdiction for all disputes arising from this contract if the contract or claims arising from the contract can be attributed to the customer's professional or commercial activity. However, in the aforementioned cases, the Seller shall in any case be entitled to invoke the court at the Customer's place of business.
Dispute resolution

This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.
The seller is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
